I have found the final piece of evidence we need to prove that John TPM was not Corporal John Rogers of the 3rd Virginia Regiment.
From Mary B. Kegley's "Militia of Montgomery County, Virginia, 1777-1790," page 50, "OATH OF ALLEGIANCE. As required by law, Montgomery County kept a list of those persons who took the oath of allegiance to the Commonwealth of Virginia, 1777-1779. These records have been preserved and can be found at the courthouse in Christiansburg." Page 53 & 54, "John Montgomery turned in two lists of those persons who took the Oath of Allegiance. The first began on September 6, 1777, and was presented to the court on February 14, 1778." (William Rogers, John Rogers, Benjamin Rogers, Jr., Joseph Rogers are on this first list.)
"The second began on March 2, 1778, and was presented October 6, in the same year" Benjamin Rogers (this would be Benjamin Sr.) is on the second list.
Corporal John Rogers Service Record for the 3rd Virginia Regiment indicates that he was with this regiment during the period from Sept. 6, 1777-Feb. 18, 1778.
Conclusion:
Corporal John Rogers was with the 3rd VA Regiment at Yorktown when John Montgomery presented the first list to the court on 2/14/1778. John (TPM) Rogers gave his oath of allegiance to the Commonwealth in Montgomery County during this period.
